1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Shenzhen OTalk Technology Co. Ltd. ("Company," "we," "us," or "our") governing your access to and use of the Paw AI mobile application (the "App") on iOS.
By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not download or use the App.
2. Eligibility & User Accounts
You must be at least 13 years old to create an account and use the App. By creating an account, you represent and warrant that you are 13 years of age or older. The App is not directed at children under 13, and we do not knowingly collect personal information from children under 13.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@otalktech.com of any unauthorized use of your account.
3. Medical & Veterinary Disclaimer
Dr. Paw is an AI assistant and does not replace a licensed veterinarian. All AI outputs are informational and should be treated as general guidance only. The Company assumes no liability for any actions taken based on AI-generated content within the App.
4. WSAVA Calorie Engine Disclaimer
The calorie engine uses the Resting Energy Requirement (RER) formula (70 × bodyWeight^0.75) with activity multipliers adjusted for age, neutered status, breed group, and pet size, based on publicly available WSAVA guidelines. Results are estimates and individual pet needs may vary significantly.
5. License Grant
Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on an iOS device that you own or control, solely for your personal, non-commercial purposes.
You may not: (a) copy, modify, or distribute the App; (b) reverse engineer or attempt to extract the source code; (c) sublicense or sell access to the App; (d) use the App for any unlawful purpose; or (e) use the App in any manner that could damage, disable, or impair the App or its servers.
6. Subscriptions & Payments (Apple StoreKit)
Paw AI offers premium features through auto-renewing subscriptions ("Pro" subscription). The App offers limited free functionality, including capped daily AI queries. Full access requires a paid Pro subscription. There is no free trial period.
6.1 Pricing
Subscription prices are displayed in the App and may vary by region. Current pricing is always available on the subscription page within the App. Prices may be updated from time to time in accordance with applicable App Store policies.
6.2 Auto-Renewal
Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price.
6.3 Cancellation & Refunds
All subscription management, cancellations, and refund requests must be handled directly through your Apple ID Account Settings (Settings → [Your Name] → Subscriptions). Paw AI cannot directly process refunds for transactions made through Apple's StoreKit. For refund requests, please contact Apple Support directly.
7. Community Guidelines & User-Generated Content
Paw AI maintains a strictly ZERO-TOLERANCE policy for objectionable content and abusive behavior. By using the App's community features (including the social map, events, and hazard reports), you agree not to post, upload, or share content that:
- Contains pornography, explicit sexual content, or nudity.
- Depicts or promotes violence, animal abuse, or cruelty.
- Constitutes hate speech targeting any individual or group.
- Harasses, bullies, or threatens other users.
- Is false, misleading, or fraudulent.
- Violates any applicable law or regulation.
Users may report inappropriate content or behavior via the in-app "Report" function. All reports are reviewed by the Paw AI team within 48 hours of submission. Upon review, we may dismiss the report, remove the reported content, warn the user, or suspend/permanently ban the account.
7.1 Content Ownership
You retain ownership of the content you post. By posting content, you grant the Company a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content solely for the purpose of operating and improving the App.
8. Anti-Abuse & System Integrity
Certain community features, such as creating offline Events at a specific location, require verified check-in history. To create an event at a location, a user must have completed a minimum of 5 qualifying visits to that specific location, with each visit lasting at least 15 minutes. This requirement exists to prevent spam and ensure that event organizers are genuinely familiar with the venue.
The following actions are strictly prohibited and will result in immediate account suspension:
- Spoofing, faking, or manipulating GPS location data.
- Attempting to manipulate the database or backend systems.
- Using automated scripts, bots, or other tools to bypass App limitations.
- Creating multiple accounts to circumvent bans or restrictions.
- Any other attempt to gain unauthorized access to App features or data.
9. Offline Event Liability Waiver
We strongly encourage all users to exercise personal judgment and take appropriate safety precautions when attending any offline event organized through the App.
10. Intellectual Property
The App and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of Shenzhen OTalk Technology Co. Ltd. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.
"Dr. Paw" is a proprietary AI persona and mascot of Paw AI. All rights reserved.
11. Termination & Account Appeals
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease.
11.1 Appeal Process
If you believe your account was suspended or banned in error, you may submit one appeal per ban by emailing support@otalktech.com with the subject line: "Account Appeal — [your username or registered email]". Appeals are reviewed within 5–10 business days. The Company will respond with a final decision via email. One appeal per ban is permitted.
12. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Shenzhen OTalk Technology Co. Ltd., its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the App.
The Company's total liability to you for any claims arising from or related to these Terms or the App shall not exceed the amount you paid to the Company in the 12 months preceding the claim.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Shenzhen, China.
Notwithstanding the foregoing, the Company reserves the right to seek injunctive or other equitable relief in any jurisdiction to protect its intellectual property rights.
14. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, either through an in-app notification or by updating the "Last Updated" date on this page. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the App after revisions become effective, you agree to be bound by the revised Terms.
